CCPA Notice at Collection

Applicability note. SmartVolve does not currently meet any of the three CCPA business thresholds (Cal. Civ. Code § 1798.140(d)) and is therefore not strictly subject to the CCPA. We publish this notice voluntarily for California residents who interact with the website or with a voice agent operated for one of our customers.
1. Categories of personal information collected
Over the past 12 months SmartVolve has collected the following categories of personal information from California residents, as defined by Cal. Civ. Code § 1798.140(v):
- Identifiers — name, email, IP address, online identifiers.
- Customer records — business email, company name, professional role.
- Commercial information — products or services requested or considered.
- Internet or other network activity — browsing history on smartvolve.com, interactions with our forms.
- Audio, electronic, or similar information — for inbound calls to a customer of ours that uses the SmartVolve voice agent, the textual transcript of the conversation. Audio itself is not stored by default.
- Inferences — none drawn for profiling purposes.
2. Purposes
We use this information to respond to commercial inquiries, deliver the voice AI service contracted by our B2B customer, send transactional communications, maintain security and prevent fraud, and comply with legal obligations.
3. Sources
Personal information is collected directly from you (forms, phone calls, email) or through automatic technologies on our website (server logs, cookies you have accepted).
4. Sale or sharing of personal information
SmartVolve does not sell personal information for monetary consideration and does not sharepersonal information for cross-context behavioural advertising as defined by the CPRA (Cal. Civ. Code § 1798.140(ah)). No "Do Not Sell or Share My Personal Information" opt-out is required because the underlying activity is not occurring.
5. Sensitive personal information
SmartVolve does not knowingly collect sensitive personal information as defined by Cal. Civ. Code § 1798.140(ae) (precise geolocation, racial or ethnic origin, religious beliefs, union membership, genetic data, biometric identifiers, health data, sexual life or orientation). If such information is voluntarily disclosed by a caller during a phone conversation, it is treated under the same retention and security regime as other content and is irreversibly anonymised within 30 days.
6. Retention
Lead-capture data is retained for 24 months from last contact and then anonymised. Voice agent transcripts are pseudonymised at 30 days and irreversibly anonymised in the same processing pass (identifier map dropped, free text regex-NER stripped of identifiers).
7. Your CCPA/CPRA rights
California residents have the right to:
- Know what personal information we have collected about them.
- Request deletion of personal information.
- Correct inaccurate personal information.
- Opt out of the sale or sharing of personal information (not applicable — we do neither).
- Limit the use of sensitive personal information (not applicable — we do not knowingly collect it).
- Non-discrimination for exercising the above rights.
8. How to exercise your rights
Send a request to [email protected] from the email address associated with the personal information. We respond within 45 days, with a single 45-day extension allowed if reasonably necessary and communicated to you in advance.
9. Authorised agents
You may use an authorised agent to submit a request on your behalf. We will require written authorisation from you and may verify the agent's identity. See California Code of Regulations, tit. 11, § 7063.
10. Children under 16
SmartVolve does not knowingly collect or process personal information from California residents under 16 without affirmative authorisation (opt-in) consistent with Cal. Civ. Code § 1798.120(c).
11. Updates
This notice is updated whenever California privacy law materially changes or our processing materially changes. The version date at the top reflects the most recent update.
